In a federal lawsuit filed on Monday, the mother of a man, who was fatally shot by the south suburban Dolton police officers in the last summer claims that they used excessive force.
Donte L. Johnson, aged 30, of Blue Island, was fatally shot by the police when two Dolton officers responded to a report of an armed robbery at about 5 a.m. on 26th June, 2016 at a Shell gas station, 1445 E. Sibley Blvd., according to the Dolton police and court documents.
When police arrived at the scene, Johnson was pointing a gun at someone outside the Shell station, and then Johnson pointed the gun at the police officers as they approached with their weapons drawn, said the police.
Johnson was shot multiple times by the police officers and was pronounced dead at 5:18 a.m., said the Cook County medical examiner’s office.
The victim of the robbery was hit by Johnson in the head with the butt of his gun and received stitches at the St. Margaret’s Hospital in Hammond, Indiana, police said at the time of the incident.

Saqueena Easterwood, Johnson’s mother, filed the lawsuit on Monday in U.S. District Court against the two officers and the village of Dolton. She claims that the officers used excessive force in violation of her son’s civil rights when they shot him dead, according to the suit filed.
Easterwood claims that Johnson did not pose a threat to officers, who recklessly discharged their weapons as he tried to run away from the scene, according to the suit filed.
In the suit filed, Easterwood is seeking unspecified damages from both the police officers and also from the village of Dolton.
